Gilbert F. Ganucheau, Jr., practices with the law firm of Kathleen L. DeBruhl & Associates, L.L.C. in New Orleans.   Mr. Ganucheau's representation focuses on federal and state regulatory issues including Medicare and Medicaid compliance, reimbursement, audits and appeals, antitrust, physician recruitment and contracting, medical staff issues, integrated delivery systems, including PHOs and IPAs, Medicare fraud and abuse, including enforcement and compliance issues, as well as insurance industry compliance and fraud.  Mr. Ganucheau has previously served as Associate General Counsel and Compliance Officer to a local community hospital. 


Mr. Ganucheau serves as lead litigation counsel for the firm and has successfully handled several multi-million dollar arbitration proceedings, as well as several other matters in arbitration, federal and state court, and administrative hearings.  These matters include false claims, fraud and abuse, physician staff disputes, healthcare related construction disputes, healthcare related contractual disputes, and Medicare and Medicaid regulatory matters.  The arbitration proceedings were administered through the American Arbitration Association and the American Health Lawyers Association, Alternative Dispute Resolution Servicer.   Mr. Ganucheau'
s services have included the development and implementation of compliance programs for individual and small group practices as well as serving as compliance counsel for the Faculty Group Practice of a teaching institution.

  • U.S. ex rel. Stewart v. The Louisiana Clinic, CA# 99-1767, U.S.D.C Eastern District of Louisiana; (Defense of qui tam action brought by former employees)
  • Mixon v. Iberia Surgical Center, L.L.C., #06-878 La. Ct. of Appeals, 3rd Circuit; (successful defense of a wrongful termination action by a member of a limited liability company)
  • Rdzanek v. Hospital Services District No. #3, CA# 903-2585, U.S.D.C Eastern District of Louisiana; (Injunction proceeding related to hospital fair hearing proceeding for action involving physician credentials)

Other Litigation Matters:

Successful defense of an arbitration action by a lithotripsy company seeking to enforce a non-competition agreement against former members.

Successful defense, resulting in voluntary dismissal, of a qui tam/false claims action against a multi-physician practice, including a claim for retaliatory discharge.

Successful arbitration demand by a health plan against a capitated physician hospital organization resulting in settlement of $2.9 million payment to the health plan.
